TERMS AND CONDITIONS OF PARTICIPATION – ACT RIDE & TRAIN

In addition to the General Terms and Conditions (GTC) of Adventure Country Tracks e.V., the following terms and conditions of participation apply to participation in the ACT Ride & Train event.

 

  1. SCOPE

These terms and conditions apply to all events of the ‘ACT Ride & Train’ format organised and carried out by Adventure Country Tracks e.V. (ACT e.V.).

 

  1. PARTICIPATION REQUIREMENTS

(1) Participation requires a responsible attitude, basic off-road riding skills and appropriate technical preparation.

(2) By booking and participating, each participant confirms:

  1. that they have basic off-road riding experience and can safely control the motorcycle on gravel and unpaved surfaces.
  2. that they understand that ACT Ride & Train is not a beginner’s course, but a guided event with integrated training elements.
  3. that they are physically and mentally capable of completing several days of riding in a row.

(3) Minors are not permitted to participate.

 

  1. MOTORCYCLE & EQUIPMENT

– Participants must have a valid driving licence.

– The motorcycle used must be road legal, insured and in perfect technical condition.

– The motorcycle used must have a minimum range of 150 km.

– Suitable off-road or adventure tyres are mandatory.

– The following protective equipment is mandatory:

  • Approved motorcycle helmet
  • Protective jacket and trousers
  • Gloves
  • Off-road or adventure boots

 

  1. RESPONSIBILITY & CONDUCT
  2. The instructions of the ACT instructors must be followed at all times.
  3. National and local laws, regulations and driving bans must be observed.
  4. All participants undertake to comply with the ACT Code of Conduct, in particular to behave respectfully towards nature, residents and other participants.
  5. ACT e.V. reserves the right to exclude participants from the event in the event of gross violations of safety rules, inappropriate behaviour or insufficient riding skills. In this case, there is no entitlement to a refund.

 

  1. DISCLAIMER & ASSUMPTION OF RISK

(1) Motorcycling, especially off-road, involves particular risks. Participation in ACT Ride & Train is voluntary and at your own risk.

(2) By participating, participants expressly acknowledge that, despite professional instruction and safety briefings, injuries or property damage cannot be ruled out.

(2) A prerequisite for participation is the signing of a separate liability waiver. This liability waiver is an integral part of the conditions of participation.

 

  1. LIMITATION OF LIABILITY

(1) The liability of ACT e.V. is governed by the statutory provisions of §§ 651a ff. BGB (German Civil Code) (package travel law).

(2) ACT e.V. is liable without limitation for damages resulting from injury to life, limb or health in accordance with the statutory provisions.

(3) ACT e.V. is liable for other damages if these are based on an intentional or grossly negligent breach of duty by ACT e.V., its legal representatives or vicarious agents.

(4) Insofar as damage was not caused intentionally or through gross negligence and does not involve damage resulting from injury to life, limb or health, liability is limited to three times the travel price.

(5) ACT e.V. shall only be liable for damage to the motorcycle used, personal equipment or other property of the participant if the damage is due to a culpable breach of duty by ACT e.V., its legal representatives or vicarious agents.

(6) ACT Ride & Train is a guided off-road event. Each participant is responsible for the safe control of their vehicle and for complying with all traffic and safety regulations. ACT e.V. shall not be liable for damage resulting from driving errors, insufficient vehicle control or typical risks associated with off-road motorcycling, provided that there is no culpable behaviour on the part of ACT e.V.

(7) ACT e.V. is not liable for service disruptions in connection with services that are merely arranged as third-party services (e.g. individual arrival and departure), provided that these services are expressly identified as third-party services in the service description.

(8) Participation is subject to the signing of a separate waiver of liability. This specifies the risks associated with participation, in particular the special dangers of off-road riding, and is an integral part of the travel contract. Mandatory statutory liability provisions remain unaffected by this.

(9) Mandatory statutory liability provisions remain unaffected.

 

  1. SAFETY & IMPLEMENTATION

(1) The events are guided group tours, not competitions or races.

(2) Safety instructions are binding. Grossly negligent or reckless behaviour may result in immediate exclusion.

(3) Participants are aware that parts of the event may take place in remote regions with limited infrastructure. Medical care, rescue or repatriation cannot be guaranteed at all times.

 

  1. SERVICES & PRICES

The price includes:

– Guided ACT Ride & Train Experience

– Integrated off-road training and coaching elements

– Support from two certified ACT instructors/guides

– Tour planning and route guidance

– Daily rider briefings and feedback

– ACT finisher sticker

– Organisation and on-site coordination

– Accommodation

– Two group dinners

The price does not include:

– Drinks and other meals

– Fuel

– Motorcycle rental

– Spare parts, repairs or technical assistance beyond pure advice

– Personal insurance

– Individual arrival and departure

 

  1. BOOKING & PAYMENT

(1) By completing the booking process via the ACT e.V. website, the participant submits a binding offer to conclude a travel contract.

(2) The travel contract is concluded upon receipt of the travel confirmation. The travel confirmation is sent in text form together with the legally required travel security certificate in accordance with § 651r BGB (German Civil Code).

(3) Upon receipt of the travel confirmation and the travel security certificate, a deposit of 20% of the travel price is due. Payment is made as part of the booking process.

(4) The remaining payment is due no later than 6 weeks before the start of the event. A separate payment request will be sent.

(5) If a due payment is not received despite a reminder and the setting of a reasonable deadline, ACT e.V. is entitled to withdraw from the contract and demand lump-sum compensation in accordance with clause 10 of these terms and conditions of participation.

(6) Payments towards the travel price may only be demanded or accepted upon presentation of the travel insurance certificate.

 

  1. WITHDRAWAL BY PARTICIPANTS

The registrant is entitled to withdraw from the contract at any time. Withdrawal must be made in writing; transmission by email is sufficient.

In the event of withdrawal, the following cancellation conditions apply:

– up to 60 days before the start of the event: 20% of the event price

– 59 – 30 days before the start of the event: 50% of the event price

– 29 – 14 days before the start of the event: 75% of the event price

– Less than 14 days before the start of the event or in case of no-show: 90% of the event price

The date of receipt of the written notice of withdrawal by ACT e.V. shall be decisive for the deadline.

The participant reserves the right to prove that the organiser has incurred no or significantly less damage.

ACT e.V. expressly recommends taking out travel cancellation or event cancellation insurance.

 

  1. CONTRACT TRANSFER / REPLACEMENT PARTICIPANTS

The participant may provide a replacement person until the start of the trip, provided that this person meets the participation requirements.

The transfer of the contract requires the prior written consent of ACT e.V.

ACT e.V. reserves the right to reject replacement participants if there are safety, qualification or organisational reasons for doing so.

 

  1. CANCELLATION BY ACT E.V.

(1) If the minimum number of participants specified in the advertisement is not reached, ACT e.V. is entitled to withdraw from the travel contract. Withdrawal shall take place no later than 21 days before the start of the event. Payments already made will be refunded in full.

(2) ACT e.V. is also entitled to withdraw from the contract before the start of the trip if ACT e.V. is prevented from fulfilling the contract due to unavoidable, exceptional circumstances. In this case, ACT e.V. will declare its withdrawal immediately. Any payments already made will be refunded in full.

(3) Further claims shall only exist within the framework of the statutory provisions.

 

  1. DATA PROTECTION

Personal data will only be processed within the framework of the event. The current data protection declaration of ACT e.V. applies.

 

  1. APPLICABLE LAW

German law applies exclusively. The place of jurisdiction is, as far as legally permissible, the registered office of Adventure Country Tracks e.V.

This regulation serves the purposes of quality assurance, safety and a reasonable group size.

These conditions of participation are available in German and English. In the event of discrepancies or differences in interpretation, the German version shall be authoritative.
