TEILNAHMEBEDINGUNGEN – ACT RIDE & TRAIN (English further below)

Ergänzend zu den Allgemeinen Geschäftsbedingungen (AGB) des Adventure Country Tracks e.V. gelten für die Teilnahme an der Veranstaltung ACT Ride & Train die nachfolgenden Teilnahmebedingungen.

1. GELTUNGSBEREICH

Diese Teilnahmebedingungen gelten für alle Veranstaltungen des Formats „ACT Ride & Train“, die vom Adventure Country Tracks e.V. (ACT e.V.) organisiert und durchgeführt werden.

2. TEILNAHMEVORAUSSETZUNGEN

(1) Die Teilnahme setzt eine verantwortungsbewusste Einstellung,     grundlegende fahrerische Fähigkeiten im Offroad-Bereich sowie eine entsprechende technische Vorbereitung voraus.

(2) Mit der Buchung und Teilnahme bestätigt jede teilnehmende Person:

1. über grundlegende Offroad-Fahrerfahrung zu verfügen und das Motorrad sicher auf Schotter und unbefestigtem Untergrund beherrschen zu können.

2. zu verstehen, dass ACT Ride & Train keine Anfängerschulung ist, sondern ein geführtes Event mit integrierten Trainingselementen.

3. körperlich und geistig in der Lage zu sein, mehrere Fahrtage in Folge zu absolvieren.

3. MOTORRAD & AUSRÜSTUNG

– Teilnehmer verfügen über eine gültige Fahrerlaubnis.

– Das eingesetzte Motorrad muss straßenzugelassen, versichert und in technisch einwandfreiem Zustand sein.

– Das eingesetze Motorrad hat eine Mindestreichweite von 150km.

– Geeignete Offroad- oder Adventure-Reifen sind verpflichtend.

– Folgende Schutzausrüstung ist zwingend erforderlich:

  • zugelassener Motorradhelm

  • Schutzjacke und -hose

  • Handschuhe

  • Offroad- oder Adventure-taugliche Stiefel

4. VERANTWORTUNG & VERHALTEN

(1) Den Anweisungen der ACT Instruktoren ist jederzeit Folge zu leisten.

(2) Nationale und lokale Gesetze, Vorschriften sowie Fahrverbote sind einzuhalten.

(3) Alle Teilnehmenden verpflichten sich zur Einhaltung des ACT Code of Conduct, insbesondere zu respektvollem Verhalten gegenüber Natur, Anwohnern und anderen Teilnehmenden.

(4) ACT e.V. behält sich das Recht vor, Teilnehmende bei groben Verstößen gegen Sicherheitsregeln, unangemessenem Verhalten oder unzureichender Fahrkompetenz von der Veranstaltung auszuschließen. In diesem Fall besteht kein Anspruch auf Rückerstattung.

5. HAFTUNGSAUSSCHLUSS & RISIKOÜBERNAHME

(1) Motorradfahren, insbesondere im Offroad-Bereich, ist mit besonderen Risiken verbunden. Die Teilnahme an ACT Ride & Train ist freiweillig.

Mit der Teilnahme erkennen die Teilnehmenden ausdrücklich an:

– dass Offroad-Fahren Risiken wie Stürze, technische Defekte, wechselnde Untergründe, Witterungseinflüsse und abgelegene Regionen beinhaltet,

– dass die Teilnahme auf eigene Gefahr und eigene Verantwortung erfolgt,

– dass es trotz professioneller Anleitung und Sicherheitsbriefings zu Verletzungen oder Sachschäden kommen kann.

(2) Eine Erklärung über die Haftungsbeschränkung ist von den Teilnehmern zu unterzeichnen. Diese Erklärung wird dem Teiilnehmer gleichzeitig mit dem Anmledeformular übermittelt. Die Teilnehmer sind sich bewusst, dass ohne akzeptierten und/oder unterzeichneten Haftungsverzicht die Veranstalter verpflichtet sind, den jeweiligen Teilnehmer von der Teilnahme an der Veranstaltung auszuschließen. 

6. HAFTUNGSBEGRENZUNG

(1) ACT e.V., dessen Vorstände, Instruktoren, Guides und Partner haften nicht für Personen-, Sach- oder Vermögensschäden, es sei denn, diese beruhen auf grober Fahrlässigkeit oder Vorsatz, soweit gesetzlich zulässig.

(2) Für Schäden an Motorrädern, Ausrüstung oder persönlichem Eigentum wird keine Haftung übernommen.

(3) Jede teilnehmende Person ist selbst verantwortlich für ausreichenden Kranken-, Unfall- und Reiseversicherungsschutz.

7. SICHERHEIT & DURCHFÜHRUNG

(1) Die Veranstaltungen sind geführte Gruppenfahrten, keine Wettbewerbe oder Rennen.

(2) Sicherheitsanweisungen sind verbindlich. Grob fahrlässiges oder rücksichtsloses Verhalten kann zum sofortigen Ausschluss führen.

(3) Den Teilnehmenden ist bewusst, dass sich Teile der Veranstaltung in abgelegenen Regionen mit eingeschränkter Infrastruktur befinden können.
Eine jederzeitige medizinische Versorgung, Bergung oder ein Rücktransport kann nicht garantiert werden.
Die Organisation medizinischer Hilfe erfolgt – soweit möglich – unterstützend, begründet jedoch keinen Anspruch auf Leistung oder Haftung seitens ACT e.V.

8. LEISTUNGEN & PREISE

Im Preis enthalten sind:

– geführte ACT Ride & Train Experience

– integrierte Offroad-Trainings- und Coachingelemente

– Betreuung durch zwei zertifizierte ACT Instruktoren / Guides

– Tourenplanung und Routenführung

– tägliche Fahrerbesprechungen und Feedback

– ACT Ride & Train Finisher-Zertifikat

– Organisation und Vor-Ort-Koordination

– Unterkunft 

– zwei gemeinsame Abendessen

Nicht im Preis enthalten sind:

– Getränke und weitere Mahlzeiten

– Sprit

– Motorradvermietung

– Ersatzteile, Reparaturen oder technische Hilfe über reine Beratung hinaus

– persönliche Versicherungen

– individuelle An- und Abreise

9. BUCHUNG & ZAHLUNG

Eine Buchung wird mit schriftlicher Bestätigung durch ACT e.V. verbindlich.

Zahlungsmodalitäten werden im Buchungsprozess kommuniziert.

10. RÜCKTRITT DURCH TEILNEHMENDE

Der Anmelder ist berechtigt jederzeit vom Vertrag zurückzutreten. Der Rücktritt muss schriftlich erfolgen, die Übermittlung per E-Mail ist ausreichend. 

Im Falle eines Rücktritts gelten folgende Stornierungsbedingungen:

• bis zu 45 Tage vor Veranstaltungsbeginn: vollständige Rückerstattung der geleisteten Zahlung abzüglich einer Bearbeitungsgebühr in Höhe von 50 EUR
• 44 – 30 Tage vor Veranstaltungsbeginn: 40 % des Veranstaltungspreises
• 29 – 14 Tage vor Veranstaltungsbeginn: 70 % des Veranstaltungspreises
• Weniger als 14 Tage vor Veranstaltungsbeginn oder bei Nichterscheinen: 100 % des Veranstaltungspreises

Maßgeblich für die Frist ist der Eingang der schriftlichen Rücktrittserklärung bei ACT e.V.

ACT e.V. empfiehlt ausdrücklich den Abschluss einer Reiserücktritts- bzw. Veranstaltungsausfallversicherung.

11. VERTRAGSÜBERTRAGUNG / ERSATZTEILNEHMENDE 

Bis spätestens 7 Tage vor Veranstaltungsbeginn kann die Teilnahme auf eine Ersatzperson übertragen werden, sofern diese die Teilnahmevoraussetzungen erfüllt.

Die Vertragsübertragung bedarf der vorherigen schriftlichen Zustimmung durch ACT e.V.

ACT e.V. behält sich das Recht vor, Ersatzteilnehmende abzulehnen, sofern Sicherheits-, Qualifikations- oder organisatorische Gründe entgegenstehen.

12. ABSAGE DURCH ACT E.V.

(1) Wird die Mindestteilnehmerzahl nicht erreicht, behält sich ACT e.V. das Recht vor, die Veranstaltung abzusagen. Die Information erfolgt spätestens 21 Tage vor Veranstaltungsbeginn.Bereits geleistete Zahlungen werden vollständig erstattet. Weitergehende Ansprüche bestehen nicht.

(2) ACT e.V. ist berechtigt, Veranstaltungen abzusagen, zu unterbrechen, zu verschieben oder in ihrem Ablauf anzupassen, sofern Ereignisse eintreten, die außerhalb des Einflussbereichs von ACT e.V. liegen. Hierzu zählen insbesondere, jedoch nicht abschließend: 

• extreme Witterungsbedingungen
• Naturkatastrophen
• Behördliche Anordnungen, Verbote oder Einschränkungen
• Streiks sowie sonstige Fälle höherer Gewalt.  

In diesen Fällen wird ACT e.V. sich bemühen, den Teilnehmenden einen Ersatztermin oder eine angemessene alternative Lösung anzubieten. 

Weitergehende Ansprüche, insbesondere Schadensersatzansprüche oder Ansprüche auf Ersatz von Aufwendungen, bestehen nicht. 

Diese Regelung dient der Qualitätssicherung, Sicherheit und einer sinnvollen Gruppengröße.

Diese Teilnahmebedingungen werden in deutscher und englischer Sprache zur Verfügung gestellt. Im Falle von Abweichungen oder Auslegungsunterschieden ist ausschließlich die deutsche Fassung maßgeblich.

PARTICIPATION CONDITIONS – ACT RIDE & TRAIN

In addition to the General Terms and Conditions (GTC) of Adventure Country Tracks e.V., the following participation conditions apply to participation in the ACT Ride & Train event.

1. SCOPE OF APPLICATION

These participation conditions apply to all events of the “ACT Ride & Train” format organized and conducted by Adventure Country Tracks e.V. (ACT e.V.).

2. PARTICIPATION REQUIREMENTS

(1) Participation requires a responsible attitude, basic off-road riding skills, and appropriate technical preparation.

(2) By booking and participating, each participant confirms that they:

1. have basic off-road riding experience and are able to safely control their motorcycle on gravel and unpaved terrain,

2. understand that ACT Ride & Train is not a beginner training course, but a guided event with integrated training elements,

3. are physically and mentally fit to ride multiple consecutive days.

3. MOTORCYCLE & EQUIPMENT

Participants must hold a valid motorcycle driving license.

The motorcycle used must be road-legal, insured, and in technically sound condition.,The motorcycle must have a minimum operating range of 150 km.

Suitable off-road or adventure tires are mandatory.

The following protective equipment is compulsory:

  • approved motorcycle helmet

  • protective jacket and pants

  • gloves

  • off-road or adventure-capable boots

4. RESPONSIBILITY & CONDUCT

(1) Instructions given by ACT instructors must be followed at all times.

(2) National and local laws, regulations, and riding restrictions must be observed.

(3) All participants commit to complying with the ACT Code of Conduct, in particular respectful behavior towards nature, local residents, and fellow participants.

(4) ACT e.V. reserves the right to exclude participants from the event in the event of serious violations of safety rules, inappropriate behavior, or insufficient riding competence. In such cases, there is no entitlement to a refund.

5. DISCLAIMER OF LIABILITY & ASSUMPTION OF RISK

(1) Motorcycle riding, especially off-road riding, involves particular risks. Participation in ACT Ride & Train is voluntary.

By participating, participants expressly acknowledge:

– that off-road riding involves risks such as falls, technical defects, changing surfaces, weather conditions, and remote regions,

– that participation is at their own risk and responsibility,

– that injuries or property damage may occur despite professional guidance and safety briefings.

(2) Participants are required to sign a declaration regarding the limitation of liability. This declaration will be provided to the participant together with the registration form. Participants are aware that without an accepted and/or signed waiver of liability, the organizers are obliged to exclude the respective participant from taking part in the event.

6. LIMITATION OF LIABILITY

(1) ACT e.V., its board members, instructors, guides, and partners shall not be liable for personal injury, property damage, or financial loss, unless caused by gross negligence or intent, insofar as legally permissible.

(2) No liability is assumed for damage to motorcycles, equipment, or personal belongings.

(3) Each participant is personally responsible for adequate health, accident, and travel insurance coverage.

7. SAFETY & EXECUTION

(1) The events are guided group rides and are not competitions or races.

(2) Safety instructions are binding. Grossly negligent or reckless behavior may result in immediate exclusion from the event.

(3) Participants are aware that parts of the event may take place in remote regions with limited infrastructure. Continuous medical care, recovery services, or return transport cannot be guaranteed at all times. The organization of medical assistance will be provided on a supportive basis where possible, but does not constitute any entitlement to services or liability on the part of ACT e.V.

8. SERVICES & PRICES

The price includes:

– guided ACT Ride & Train experience

– integrated off-road training and coaching elements

– supervision by two certified ACT instructors / guides

– tour planning and route guidance

– daily rider briefings and feedback sessions

– ACT Ride & Train finisher certificate

– organization and on-site coordination

– accommodation

– two shared evening meals

The price does not include:

– beverages and additional meals

– fuel

– motorcycle rental

– spare parts, repairs, or technical assistance beyond advisory support

– personal insurance

– individual arrival and departure

9. BOOKING & PAYMENT

A booking becomes binding upon written confirmation by ACT e.V. Payment terms will be communicated during the booking process.

10. CANCELLATION BY PARTICIPANTS

The registrant is entitled to withdraw from the contract at any time. Withdrawal must be made in writing; transmission by e-mail is sufficient. 

In the event of withdrawal, the following cancellation conditions apply:

• Up to 45 days before the start of the event: full refund of the payment made, less a processing fee of EUR 50.
• 44–30 days before the start of the event: 40% of the event price
• 29–14 days before the start of the event: 70% of the event price
• Less than 14 days before the start of the event or in case of no-show: 100% of the event price

The date of receipt of the written notice of withdrawal by ACT e.V. is decisive for the deadline.

ACT e.V. expressly recommends taking out travel cancellation or event cancellation insurance.

11. TRANSFER OF CONTRACT / SUBSTITUTE PARTICIPANTS

Up to 7 days before the start of the event, participation may be transferred to a substitute participant, provided they meet the participation requirements.

The transfer of the contract requires prior written approval by ACT e.V.

ACT e.V. reserves the right to reject substitute participants for safety, qualification, or organizational reasons.

12. CANCELLATION BY ACT E.V.

(1) If the minimum number of participants is not reached, ACT e.V. reserves the right to cancel the event. Participants will be informed no later than 21 days before the start of the event. Any payments already made will be refunded in full. No further claims may be asserted.

(2) ACT e.V. is entitled to cancel, interrupt, postpone or adjust events if circumstances arise that are beyond the control of ACT e.V. These include, but are not limited to:     

• Extreme weather conditions
• Natural disasters
• Official orders, bans or restrictions. 
• Strikes and other cases of force majeure.  

In such cases, ACT e.V. will endeavour to offer participants an alternative date or a suitable alternative solution. No further claims, in particular claims for damages or reimbursement of expenses, shall be accepted.

This regulation serves quality assurance, safety, and a reasonable group size.

These participation conditions are provided in German and English. In the event of any discrepancies or differences in interpretation, the German version shall prevail.
