This disclaimer supplements the terms and conditions of participation of ACT Ride & Train and is a prerequisite for participation.

1. Subject matter of the declaration

This disclaimer applies to participation in an ‘ACT Ride & Train’ event, a guided adventure motorcycle event with integrated training and coaching elements. Participants must use their own motorcycles. 

2. Voluntary participation and knowledge of the requirements

Participation in ACT Ride & Train is voluntary. By booking, but no later than the actual start of the event, the participant confirms that they have understood the aim, schedule, content and requirements of the event. 

3. Assumption of risk

The participant is aware that motorcycling – especially off-road – involves considerable risks, in particular due to falls, changing surfaces, technical defects, weather conditions and remote regions.

Participation is at your own risk and responsibility.

4. Liability and limitation of liability

Each participant bears sole civil liability for any damage they cause.

The liability of ACT e.V., its board members, instructors, guides and vicarious agents is governed by the statutory provisions, in particular §§ 651a ff. BGB (German Civil Code) (package travel law).

ACT e.V. is liable without limitation for damage resulting from injury to life, limb or health in accordance with the statutory provisions.

ACT e.V. is only liable for other damage if it is based on an intentional or grossly negligent breach of duty. If damage was caused neither intentionally nor through gross negligence and does not involve injury to life, limb or health, liability is limited to three times the price of the trip.

Damage to the motorcycle used, equipment or personal property shall only give rise to liability on the part of ACT e.V. if it is based on a culpable breach of duty by ACT e.V.

Typical risks of off-road motorcycling, in particular falls through no fault of the organisation, shall not give rise to any liability on the part of ACT e.V.

Mandatory statutory liability provisions remain unaffected.

5. Traffic regulations and behaviour

The participant undertakes to comply with all applicable national and local laws as well as traffic and driving restrictions. ACT Ride & Train is not a racing or competitive event. 

6. Personal requirements

The participant declares that they are physically, mentally and health-wise capable of riding the motorcycle safely, that they are in possession of a valid driving licence and that they are not under the influence of alcohol, drugs or medication that could impair their ability to drive.

7. Technical condition of the motorcycle

The participant is responsible for ensuring that the motorcycle is in perfect technical condition and roadworthy, and undertakes to report any defects to a representative of ACT e.V. without delay.

8. Medical care

Participants are aware that parts of the event may take place in remote regions with limited infrastructure. Medical care, rescue or repatriation cannot be guaranteed at all times. 

9. Insurance

There is no separate event insurance. Each participant is responsible for ensuring that they have adequate health, accident and travel insurance cover.

10. Exclusion

ACT e.V. reserves the right to exclude participants from the event in the event of safety-related or grossly negligent behaviour. In this case, there is no entitlement to a refund. 

11. Severability clause

Should individual provisions of this disclaimer be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.

12. Final confirmation

I declare that I have read, understood and accepted this disclaimer.

Language Clause

This waiver is provided in English for information purposes. In case of any discrepancies or differences in interpretation, the German version shall prevail.
