1. Gegenstand der Erklärung

Dieser Haftungsverzicht gilt für die Teilnahme an einer Veranstaltung „ACT Ride & Train“, einer geführten Adventure-Motorradveranstaltung mit integrierten Trainings- und Coachingelementen. Die Teilnahme erfolgt mit eigenem Motorrad.

2. Freiwillige Teilnahme und Kenntnis der Anforderungen

Die Teilnahme an ACT Ride & Train erfolgt freiwillig. Mit der Buchung, spätestens jedoch mit dem tatsächlichen Antritt der Veranstaltung, bestätigt die teilnehmende Person, Ziel, Ablauf, Inhalt und Anforderungen der Veranstaltung verstanden zu haben.

3. Risikoübernahme

Der teilnehmenden Person ist bewusst, dass Motorradfahren – insbesondere im Offroad-Bereich – mit erheblichen Risiken verbunden ist, insbesondere durch Stürze, wechselnde Untergründe, technische Defekte, Witterungseinflüsse sowie abgelegene Regionen.

Die Teilnahme erfolgt auf eigene Gefahr und eigene Verantwortung.

4. Haftung und Haftungsbegrenzung

Jede teilnehmende Person trägt die alleinige zivil- und strafrechtliche Verantwortung für alle von ihr verursachten Schäden.

ACT e.V., dessen Vorstände, Instruktoren, Guides und Erfüllungsgehilfen haften nur bei Vorsatz oder grober Fahrlässigkeit, soweit gesetzlich zulässig.

Eine Haftung für einfache Fahrlässigkeit sowie für Schäden an Motorrädern, Ausrüstung oder persönlichem Eigentum ist ausgeschlossen.

5. Verkehrsvorschriften und Verhalten

Die teilnehmende Person verpflichtet sich, alle geltenden nationalen und lokalen Gesetze sowie Verkehrs- und Fahrverbote einzuhalten. ACT Ride & Train ist keine Renn- oder Wettbewerbsveranstaltung.

6. Persönliche Voraussetzungen

Die teilnehmende Person erklärt, körperlich, geistig und gesundheitlich in der Lage zu sein, das Motorrad sicher zu führen, im Besitz einer gültigen Fahrerlaubnis zu sein und nicht unter dem Einfluss von Alkohol, Drogen oder fahruntüchtig machenden Medikamenten zu stehen.

7. Technischer Zustand des Motorrads

Die teilnehmende Person ist verantwortlich für den technisch einwandfreien, verkehrssicheren Zustand des Motorrads und verpflichtet sich, Mängel unverzüglich einem Vertreter von ACT e.V. zu melden.

8. Medizinische Versorgung

Den Teilnehmenden ist bewusst, dass sich Teile der Veranstaltung in abgelegenen Regionen mit eingeschränkter Infrastruktur befinden können. Eine jederzeitige medizinische Versorgung, Bergung oder ein Rücktransport kann nicht garantiert werden.

9. Versicherung

Es besteht keine gesonderte Veranstaltungsversicherung. Jede teilnehmende Person ist selbst verantwortlich für ausreichenden Kranken-, Unfall- und Reiseversicherungsschutz.

10. Ausschluss

ACT e.V. behält sich vor, Teilnehmende bei sicherheitsrelevantem oder grob fahrlässigem Verhalten von der Veranstaltung auszuschließen. Ein Anspruch auf Rückerstattung besteht in diesem Fall nicht.

11. Schlussbestätigung

Ich erkläre, dass ich diesen Haftungsverzicht gelesen, verstanden und akzeptiert habe.

1. Subject of this Declaration

This waiver of liability applies to participation in the event “ACT Ride & Train”, a guided adventure motorcycle event with integrated training and coaching elements. Participation takes place using the participant’s own motorcycle.

2. Voluntary Participation and Awareness of Requirements

Participation in ACT Ride & Train is voluntary. By booking, and no later than by commencing participation in the event, the participant confirms that they have understood the objectives, structure, content, and requirements of the event.

3. Assumption of Risk

The participant is aware that motorcycle riding, especially off-road riding, involves significant risks, including but not limited to falls, changing terrain, technical failures, weather conditions, and remote locations.

Participation takes place at the participant’s own risk and responsibility.

4. Liability and Limitation of Liability

Each participant bears sole civil and criminal responsibility for any damage caused by them.

Adventure Country Tracks e.V., its board members, instructors, guides, and agents shall only be liable in cases of intent or gross negligence, insofar as legally permissible.

Liability for simple negligence, as well as for damage to motorcycles, equipment, or personal belongings, is excluded.

5. Traffic Regulations and Conduct

The participant undertakes to comply with all applicable national and local laws, regulations, and riding restrictions at all times. ACT Ride & Train is not a race or competition.

6. Personal Requirements

The participant declares that they are physically, mentally, and medically fit to safely operate a motorcycle, hold a valid driving license for the relevant vehicle class, and are not under the influence of alcohol, drugs, or any medication that may impair riding ability.

7. Technical Condition of the Motorcycle

The participant is responsible for ensuring that the motorcycle is in a technically sound and roadworthy condition and undertakes to immediately report any defects or safety concerns to a representative of Adventure Country Tracks e.V.

8. Medical Care and Emergency Services

Participants are aware that parts of the event may take place in remote regions with limited infrastructure. Continuous medical care, recovery services, or return transport cannot be guaranteed at all times.

9. Insurance

There is no separate event insurance for participants. Each participant is personally responsible for adequate health, accident, and travel insurance coverage.

10. Exclusion from the Event

Adventure Country Tracks e.V. reserves the right to exclude participants from the event in cases of safety-related misconduct or grossly negligent behavior. In such cases, there is no entitlement to a refund.

11. Final Declaration

I declare that I have read, understood, and accepted this waiver of liability.

Language Clause

This waiver is provided in English for information purposes. In case of any discrepancies or differences in interpretation, the German version shall prevail.
